THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.266 of 2017 ORDER:
The C.R.P. is filed by the petitioner/plaintiff aggrieved by the order dated 14-7-2015 in I.A.No.390 of 2015 in O.S.No.184 of 2015 on the file of Senior Civil Judge, Rajampeta whereunder the trial court in a petition filed by the petitioner/plaintiff under order 39 Rule 1 read with 151 C.P.C. for granting mandatory injunction, directed the urgent notice to the respondents. The grievance of the petitioner is that the trial court ought to have granted exparte order considering the material.
When the matter came up for hearing, learned counsel for the petitioner would submit that in view of the urgency in the matter, the trial court may be directed to dispose of I.A.No.390 of 2015 in O.S.No.184 of 2015 within specified time.
In view of his submission, this C.R.P. is disposed of at the admission stage with a direction to the trial court to dispose of I.A.No.390 of 2015 in O.s.No.184 of 2015 within two months from the date of receipt of a copy of this order.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
