HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.430 OF 2017 ORDER:

This criminal petition is filed under Section 438 of Cr.P.C, for grant of pre-arrest bail in connection with Crime No.197 of 2016 for the offences punishable under Sections 406, 420, 385, 323 r/w.34 I.P.C of P.S.Shankarpally, apprehending his arrest in connection with the above crime.

During the course of hearing, learned counsel for the petitioner requested to permit the petitioner to surrender before the Magistrate concerned and to direct the Magistrate to decide the bail application if any filed, on the same day, without touching merits of the case.

Acceding to the request of learned counsel for the petitioner, instead of deciding the matter on merits, as requested, I deem it appropriate to permit the petitioner to surrender before the Judicial Magistrate of First Class, Chevella. On such surrender and on filing of any application for grant of bail, after issuing notice to the Public prosecutor, the trial Court is directed to decide the petition on the same day.

With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions, pending if any, in this criminal petition, shall stand closed.
