CVNR,J & MSKJ,J WP.13816 of 2017 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.13816 of 2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus, directing the respondents to produce the petitioner's son, by name, Talluri Praveen Kumar (for short "the alleged detenu") before the Court and set him at liberty and handover the custody to the petitioner.

A perusal of the record shows that the alleged detenu has filed M.C.No.18/2016 in the court of II Additional Junior Civil Judge, Sattenapalli, against the petitioner for his maintenance, representing through respondent No.4, his paternal grandfather. This being admitted fact, it cannot be said that the alleged detenu is in the illegal custody of respondents Nos.4 to 6. Moreover, so far, the petitioner is not even lodged a police report against the alleged illegal detention of her minor son. As the petitioner failed to establish that her minor son is in the illegal custody of respondents Nos.4 to 6, the prayer in this writ petition cannot be granted.

In view of the above, the Writ Petition is dismissed.
