HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13834 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare that the respondents cannot effect transfers of the petitioners until they are absorbed in Government service, as illegal and arbitrary. A consequential direction is also sought not to disturb the petitioners from the 3rd respondent college till they are absorbed in Government service.

When the matter is taken up for hearing, it is noticed that during pendency of the writ petition, the petitioners have already retired from service and, hence, the question of adjudicating the case in respect of transfers at this stage would not arise. Therefore, the writ petition is dismissed as infructuous.
