HON'BLE SRI JUSTICE R. KANTHA RAO Civil Revision Petition No.849 of 2016 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India, seeking speedy disposal of IA No.285 of 2013 in ATC No.1 of 2013 on the file of the Special Officer cum Junior Civil Judge, Pithapuram. This court is of the view that notice to the opposite party is not necessary.

2. Heard Sri N. Siva Reddy, learned counsel appearing for the revision petitioners. It is submitted by the learned counsel appearing for the petitioners that the court below granted ex-parte interim injunction erroneously as long back as on 19.06.2013 in IA No.285 of 2013 in ATC No.1 of 2013 and when the petitioners pressed for vacation of the ex-parte interim injunction, the court below is not disposing of the same on merits in spite of repeated requests made by the revision petitioners.

3. Having regard to the aforesaid submission, the learned Special Officer-cum-Junior Civil Judge, Pithapuram, is directed to dispose of the injunction petition i.e., IA No.285 of 2013 in ATC No.1 of 2013, within a period of one month from the date of receipt of a copy of this order.
