Heard the learned counsel for the petitioner and the learned Government Pleader for Home for the respondents.
This writ petition is filed for a writ of mandamus declaring the action of the respondents in not issuing 'B' form licence to the petitioner theatre as illegal, null and avoid and consequently direct the 2nd respondent - Joint Collector and Licencing Authority, to issue 'B' form licence to the petitioner. The writ petitioner is a theatre by name Saibaba Movieland, Kadapa and it is being represented by its proprietor P.Ravindranath Reddy. As per the writ averments, originally the said theatre, which was constructed in the year 1971, was owned by G.Ranga Reddy and H.Bashir Basha and the said theatre was having 'B' form licence. Subsequently, under a registered sale deed bearing document No.13959/2006 dated 17.11.2006, the said theatre was purchased by the present proprietor. The petitioner made an application dated 11.4.
2016 for transfer of 'B' form licence, permission for renovation and for reopening, to the 2nd respondent - Joint Collector and Licensing Authority. In turn the 2nd respondent directed the 3rd respondent - Revenue Divisional Officer, Kadapa to enquire and submit report and accordingly 3rd respondent submitted a detailed report on 7.6.2016. The grievance of the petitioner is that the 2nd respondent failed to issued 'B' form licence till date and hence the present writ petition.
law, with regard to issuance of 'B' form licence based on the report submitted by the 3rd respondent - Revenue Divisional Officer, as early as possible, within a period of ten days from the date of receipt of a copy of this order. No order as to costs.
