THE HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No. 5373 of 2012 ORDER:

The present writ petition is filed seeking the following relief: "To issue a writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the proceedings No.112/04/2011-FF(HC), dated 03.02.2011 is illegal, arbitrary and non application of mind and violative of principles of natural justice and contrary to the recommendations of the 2nd respondent in his letter No.7379/FF.II(A2)/2010-I, dated 20.12.2010 and consequently direct the respondents to grant the Swatantra Sainka Sanman Pension by considering the representation dated 17.1.2005 in the interest of the justice and equity and pass such order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

During the course of hearing, it is brought to the notice of this Court by the learned counsel for the petitioner that according to the information received by him, the petitioner died long back. In fact, he has addressed a letter under registered post acknowledgment due on 4.8.2016. The same has been returned unserved with an endorsement 'addressee expired'. The letter along with cover is paced before this Court and the same is placed on record. Since the learned counsel for the petitioner is unable to contact the petitioner to bring on record his legal representatives, learned counsel informs the Court that he has no instructions in the matter.

Recording the said submission, the Writ Petition is dismissed as abated. No order as to costs.

Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
