THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO Contempt Case No.452 of 2018 ORDER:- This Contempt Case is filed alleging wilful default of the order dt.07.11.2017 in W.P.No.29627 of 2017 passed by this Court directing the respondent herein to dispose of petitioner's representation within six weeks from the date of receipt of copy of the order and communicate her decision to the petitioner. 2.

Only on 18.07.2019, communication was given to the petitioner by the respondent. Thus, there is a two year period of delay between the passing of the order on 07.11.2017 and the compliance with the order.

In the counter affidavit filed by the respondent initially the respondent stated that she was posted as Tahasildar, Zaheerabad, on 05.01.2018 and relieved on 19.02.2018 and during this period, she addressed a memo to the Mandal Surveyor on 19.01.2018. 4.

Admittedly, the request of the petitioner was negatived by the respondent's successor only on 18.07.2019. No reason is assigned in the affidavit of the respondent as to why the respondent did not respond to the petitioner's representation between 05.01.2018 and 19.02.2018 and inform the petitioner what action is being taken during this period.

Therefore, this inaction of the respondent has to be held to be wilful and deliberate. So she is sentenced to pay fine of Rs.500/- (Rupees five hundred only) within four (4) weeks from the date of

receipt of copy of this order and in default, the respondent shall suffer simple imprisonment for two weeks.

Accordingly, the Contempt Case is allowed. Consequently, miscellaneous petitions if any pending in the Contempt Case shall stand dismissed.
