It is represented by the learned Counsel appearing on either side that the appellant-committee has become defunct as its Secretary died more than 10 years back. No steps whatsoever have been taken to come on record representing the appellant-committee to prosecute the appeal and to set aside the consequential abatement.

Recording the aforesaid submission, the Appeal Suit is dismissed as having been abated. No order as to costs.
