HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Writ Petition No. 10064 of 2005 Order:

Learned counsel for the petitioner represents that the petitioner expired two years back.

2. As seen from the writ petition, the relief claimed by the petitioner is to direct the first respondent to sanction the pension to her under Swathanthra Sainik Sanman Pension Scheme, 1980, pursuant to the recommendations made by the second respondent, dated 11.07.2002, challenging inaction of the first respondent therefor as arbitrary and illegal by grant of Mandamus.

3. Since the petitioner is no more and her death having taken place about two years back, the cause would not survive.

4. Hence, the instant Writ Petition is dismissed as infructuous. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in the Writ Petition shall stand closed.
