THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37278 of 2016 ORDER:

This writ petition is filed seeking to set aside the proceedings in FIR No.147 of 2016.

Heard and perused the material available on record. The case of the petitioner is that the 3rd respondent filed the present complaint alleging that her husband died and the family members i.e., the petitioners took away her silver worth Rs.1,00,000/-, land documents and also the loan clearance documents worth Rs.23,000/- and one she buffalo and a calf worth Rs.20,000/- was stolen away from her cattle shed.

The grievance of the petitioners is that the 3rd respondent foisted a false case with a mala fide motive to implicate in a criminal case for untoward advantage.

Considering the said facts and circumstances, the 2nd respondent is directed to complete the investigation in FIR No.147 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 1st November, 2016 KL
