Aggrieved by the Judgment and Decree dated 31.12.2018 passed by the I Additional District Judge, Ranga Reddy District, at L.B.Nagar (for short, 'the trial Court'), in O.S.No.325 of 2012, the defendant is before this Court with this appeal. By the Judgment and Decree impugned, the trial Court dismissed the suit instituted by the plaintiff, however, held that the plaintiff is entitled to refund of the advance sale consideration of Rs.12,20,000/- with interest @ 6% per annum from the date of filing of suit till the date of realization.

Today, at the hearing, learned counsel for both the parties pray the Court to permit the plaintiff and defendant to compromise the matter in terms of the compromise entered into between the parties, by allowing the application filed in I.A.No.3 of 2019. They further submit that the terms of compromise are spelt out in the affidavit dated 04.04.2019 filed in support of I.A.No.3 of 2019.

The appellant-defendant (represented by his Agreement-cum-GPA holder), and the respondent-plaintiff are present before the Court today; and they are identified by their respective counsel. The parties state that they have amicably settled the matter by way of a compromise, and that they would abide by the 'Terms of Compromise' dated 04.04.2019, and therefore

In those circumstances, I.A.No.3 of 2019 is allowed, and the appeal is disposed of recording the compromise entered into by the parties. The Terms of Compromise dated 04.04.2019 shall form part of the order and record. No costs.
