THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.40284 of 2012 ORDER:

It is reported by the learned counsel for the petitioners as well as learned Government Pleader for Home that the issue in the present Writ Petition is squarely covered by the orders of this Court in W.P.Nos.7515 of 2010 and batch dated 18-01-2012 and a copy of the same is also placed on record in the material papers.

Following the above mentioned judgment and for the reasons recorded therein, this Writ Petition is also disposed of in the following manner: "In view of the policy notified by the Government in Memo No.44863/Ex.III.1/2011, dated 17.01.2012, I deem it appropriate to dispose of these writ petitions with a direction to the respondents not to interfere with either production or trading in black jaggery by the petitioners. However, it is made clear that in case if it is found that such black jaggery or alum or any other items are sold for the purpose of illegal distillation of arrack in connivance with such manufacturers, this order will not preclude the respondents from taking steps in accordance with law against such traders or manufacturers." The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ___________________ A.V.
