HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7562 OF 2017 ORDER:

The case of the petitioner is that he was issued notice vide Roc.564/2016 (B) under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 (for short 'the Act') in respect of the land admeasuring Ac.1.21 cents in Sy.No.470/2 of Kallaparru Village, Akividu Mandal, West Godavari District. Pursuant to the same, the petitioner submitted explanation on 29.08.2016. Without passing any orders, the respondents are tying to evict the petitioner. Aggrieved by the same, the present writ petition is filed.

Heard both sides.

In view of the above facts and circumstances, the 3rd respondent is directed to consider the explanation submitted by the petitioner on 29.08.2016 and pass final orders in accordance with law, after giving an opportunity of hearing to the petitioner. Till passing of final orders, there shall be stay of dispossession of the petitioner from the subject land. With the above direction, the writ petition is disposed of. No order as to costs.
