THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 25820 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a writ or direction more particularly one in the nature of WRIT OF MANDAMUS, declare the action of the respondents in not paying the rent as per G.O.Ms.No.63, Finance (Ex.PR.PW) Department, dated:18.04.2011 to the petitioner's building premises situated in House No. 6-3-32/2 of Maddalavaripeta Street, Amalapuramu Municipality, East Godavari District as illegal, arbitrary, contrary to G.O.Ms. No.63, Finance (Ex.PR.PW) Department, dated:18.04.2011 and also violating of Articles 300-A of the Constitution of India and consequently direct the respondents to pay the rent by re-fixing the rate of rent as per G.O.Ms.No.63 Finance (Ex.PR.PW) Department, dated: 18.04.2011 w.e.f.18.04.2011 and also pay the entire arrears till the premises vacated by following due process of law and to pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."
2. According to the petitioner, he is absolute owner and possessor of the building bearing H.No.6-3-32/2, situated at Maddalavaripeta, Amalapuramu Municipality, East Godavari District. A social welfare boys hostel is being run in the said premises. The grievance precisely in the present writ petition is non-extension of the enhanced rentals to the petitioner herein, as per G.O.Ms.No.63, Finance (EXPR.PW) Department, dated 18.04.2011. It is further submitted by the learned counsel for the petitioner that for redressal of the grievance, petitioner herein submitted a representation to the 4th respondent - Deputy Director of Social Welfare Department, Kakinada, East Godavari District, on 25.05.2015. It is also the complaint of the petitioner herein
that no action, on the said representation, has been taken by the 4th respondent.

In view of the above reasons, without expressing any opinion on the entitlement of the petitioner herein, Writ Petition is disposed of, directing the 4th respondent herein to take appropriation action on the representation dated 25.05.2015, said to have been submitted by the petitioner herein, for redressal of his grievance, within a period of one month from the date of receipt of this order.
4. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 17th August, 2015 ss
