HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 1035 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellant does not press this appeal and prays for keeping the question of jurisdiction open to be argued at the stage of final arguments before the Arbitrator, as observed by the Arbitrator in order dated 30.05.2015. The Arbitrator has observed in the order that the application would be decided at the time of final hearing along with main arbitration.
Writ appeal is disposed of as not pressed. We hope and trust that learned Arbitrator shall deal with the issue of jurisdiction also while passing the award on merits in accordance with law and uninfluenced by the orders passed by this Court.
