The Court made the following :

ORDER:

This Writ Petition is filed feeling aggrieved by proceedings in Rc.No.M.109/2009, dated 28-10-2009 of the respondent whereby he has imposed a penalty of Rs.500/- on the petitioner, who is the fair price shop dealer of Pallepadu village, Kosigi Mandal, Kurnool District, and warned her to be very alert in future in distribution of the essential commodities. As rightly submitted by Mr. N. Sreedhar Reddy, learned Counsel for the petitioner, in the impugned order, the respondent has not found the petitioner guilty of any of the six charges framed against her.

Unless the respondent has returned the finding of guilt of the petitioner, he has no jurisdiction to impose the penalty or administer the warning. Therefore, the imposition of penalty and administering of warning on the petitioner cannot be sustained and the same is accordingly set-aside.

The Writ Petition is allowed.
