SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1885 OF 2018 ORDER:
This Criminal Petition is filed seeking grant of anticipatory bail to the petitioner, who is accused, in FIR No.286 of 2017 of Tirupati East Police Station, Chittoor District.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.

As per the case of the prosecution, petitioners tried to attack the defacto complainant and also abused him in his caste name. Petitioner herein is the paramour of the wife of the defacto complainant.

Counsel for petitioner submits that though the incident occurred on 08.07.2017, the complaint was filed on 15.07.2017.

Merely on the ground that there is delay, more so, when the defacto complainant alleged threat to his life, the hurdle under Section 87 of the SC & ST Act cannot be ignored. 6.
Therefore, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner and this Criminal Petition is dismissed. However, the petitioner/accused is at liberty to surrender before the lower Court having jurisdiction
and obtain regular bail. On such petition, concerned lower Court shall dispose of the same expeditiously, preferably on the same day, subject to pressure of other work. 7.
Consequently, miscellaneous applications, if any pending, shall stand closed.
