THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.30667 of 2015 O R D E R:

This writ petition is filed under Article 226 of the Constitution of India for the following relief - " For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased issue a Writ of Mandamus or any other appropriate Writ, Order or Orders, Direction or Directions to direct the respondents 5 and 6 not to interfere with the performance of Ganesh Navaratri Celebrations by the petitioners inside the Hanuman Temple, Puppalaguda Village, Rajendranagar Mandal, R.R. District in any manner and to direct the respondents 5 and 6 to act in accordance with law and pass such other order or orders as Hon'ble Court may deem fit and proper in the circumstances of the case." When the matter is taken up for consideration, written instructions dated 21.9.2015 furnished by the S.I. Of Police, Narsingi Police Station, Cyberabad, R.R. District has been placed on record by the learned Government Pleader for Home and the relevant portion of the same reads as under :

" It is submitted that the petitioners earlier filed WP No.30234/2015 with the following prayer : " to issue a Writ of Mandamus or any other appropriate Writ, Order or Orders, Direction or Directions to direct the respondents 2 to 5 to act in accordance with law and to permit the petitioners and their associates to perform the festival celebration for 9 days from 17.9.2015 inside the Hanuman Temple situated at Puppalaguda Village, Rajendranagar Mandal, R.R. District and pass such other orders."

The Hon'ble Court by orders dated 16.9.2015 directed the police to take appropriate action on the petitioner's representation 13.9.2015 and closed the writ petition. Similarly, Smt. Sunitha of Maheswaram filed W.P.No.30397.2015 with the following prayer:

" to issue a Writ order or direction, more particularly one in the nature of Writ of Mandamus declaring the illegal action of the respondent authorities in not issuing necessary permissions to the Puppalaguda Village Temples Committee under the Chairmanship of the petitioner to install Lord Ganesh idol in Lord Hanuman Temple to proceed with the celebrations of Lord Ganesh Navaratris, as illegal, arbitrary, unconstitutional and against to the principles of natural justice and to pass such other and further orders as the Hon'ble Court may deem fit and proper in the circumstances of the case" This Hon'ble Court by orders dated 16.9.2015 directed the Police to take appropriate action on the petitioner's representation 2.9.2015, in accordance with law, and closed the Writ Petition.

It is submitted that, both the groups wanted to erect Ganesh Pandal at one place i.e., in Lord Hanuman Temple. In both the writ petitions, this Hon'ble Court directed the police to take appropriate action on the representations of the respective parties. It is submitted that, after passing of the orders by this Hon'ble Court both of them have not approached the police so far. Police have also not given permission to either of the parties." Noticing the said instructions, learned counsel for the petitioners requests to dispose of the writ petition by recording the above written instructions dated 21.9.2015. It is also submitted by the learned counsel that the petitioners may be permitted to approach the police authorities regarding their grievance and that a suitable action be taken by the police authorities.

In view of the above, the writ petition stands disposed of by recording the above written instructions dated 21.9.2015 furnished by the S.I of Police, Narsingi Police Station, Cyberabad by keeping it open for the petitioners to approach the police authorities as per law. Miscellaneous applications, if any pending in the writ petition, shall stand closed. No

costs.
