THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.3226 of 2009 ORDER:

Heard Sri Marie Desai, learned counsel for petitioner. The petitioner prays for Mandamus declaring the action of respondents in selecting and appointing unqualified personnel vide order dated 09-09-2008 as illegal, arbitrary and unconstitutional. The petitioner in W.P.M.P.No.4202 prayed for the following relief:- ".... To direct the respondents to consider the case of the applicant for appointment as ANM in any one of the existing two remaining vacancies which are not filled up...." This Court ordered W.P.M.P. as follows:- "Learned counsel for the petitioner submits that two more vacancies are existing as on this day and therefore, she seeks necessary direction to the respondents to consider the claim of the petitioner to one of the existing vacancies.

Such is the situation, there shall be interim direction to the respondents to consider the case of the petitioner for the existing vacancy, if she is otherwise, eligible, and notice." Learned counsel for petitioner submits that having regard to the interim order, no further orders are necessary. The writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
