HON'BLE SRI JUSTICE P NAVEEN RAO CRIMINAL PETITION No.16544 of 2014 ORDER:

This criminal petition is filed under Section 438 of Cr.P.C by petitioner/accused No.1 in F.I.R.No.373 of 2014 of Kothapet Police Station, Guntur Urban District for the offences punishable under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

2. Heard the learned counsel for petitioner and learned Additional Public Prosecutor for respondent -State and perused the material placed on record.

3. The case of the prosecution is that on 06.08.2014 at about 7.00 p.m. on credible information, the Inspector of Police, Lalapet Police Station, along with staff raided Ganesh Lodge situated at Rajagarithota, Guntur, where they found three persons in the first floor of the lodge and on seeing them they were fled away and among them, two persons were caught hold by the police. On enquiry, they stated that they took a lodge on lease and doing prostitution business for getting profits. On search, they found two women in room No.101 and o n examination, they disclosed that they were indulging in prostitution for earning money.

4. Learned counsel for petitioner submitted that petitioner is falsely implicated into the crime and the allegations alleged against him in the complaint do not constitute any offence and in abuse of process of law.

Having regard to the above, the Criminal Petition is disposed of by giving liberty to petitioner/accused to surrender before the learned Magistrate concerned and to move regular bail application after notice to the Public Prosecutor and in such an event, the learned Judge concerned is required to consider on its own merits the application to grant bail preferably on the same day, if not atleast on next day and subject to such conditions as may be necessary.
