Bollaboina Viswanadham, S/o. B.D.Mallaiah Petitioner (Accused-21 in Cr.No.294/2017 of Arundalpet P.S., Guntur Town, Guntur) AND The State of Andhra Pradesh, rep by Public Prosecutor, High Court, Hyderabad. Respondent Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed therein, the High Court may be pleased to direct the Investigation Officer, Regional Office, CID, Guntur, to release the petitioner/A-21 on bail in the event of his arrest in connection with the Crime No. 294 of 2017 of Regional Office, CID, Guntur.

The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri V.V.Lakshmi Narayana, Advocate for the Petitioner and of the Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:

" This Criminal Petition is filed seeking grant of anticipatory bail to the petitioner, who is accused No.21, in Crime No.294 of 2017 of Arundalpet Police Station, Guntur Town.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

Counsel for petitioner submits that the other accused in this case, who stand on the same footing as that of this petitioner, were granted anticipatory bail by this Court.

The said submission is not refuted by the learned Public Prosecutor. 5.

Hence, considering the same, this Criminal Petition is allowed. The petitioner/A21 is directed to surrender before the Station House Officer, Arundalpet Police Station within 15 days from the date of this order. On such surrender, the petitioner/A21 shall be released on bail on condition of his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioner/A21 shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under: 1) The petitioner shall make himself available for interrogation by a police officer as and when required;

2) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and 3) The petitioner shall not leave India without the previous permission of the Court.

Consequently, miscellaneous applications, if any pending, shall stand closed."
