THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20657 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to issue a Writ order or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent authorities in interfering in Civil Matter and threatening the petitioner to settle the matter with Respondent No.5 in their presence as illegal, arbitrary, biased, unconstitutional and against the principles of natural justice and consequently direct the respondent authorities not to harass the petitioner in their Civil Matter and pass..."

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not adjudicating the case on merits, it may not be necessary to hear respondent no.5.

3. The grievance of the petitioner is that there is a civil dispute between him and respondent No.5 with regard to payment of commission amount of Rs.9,80,000/- to the petitioner for marketing the product i.e. fish feed. It is his case that he received complaints from customers that the fish feed was defective and there was no proper growth of

the fish inspite of properly feeding the feed supplied by respondent No.5. Hence, he demanded respondent No.5 to come and satisfy the customers and settle the matter. It is his case that in the last week of May, 2016, respondent No.5 made a false complaint to respondent No.3 with an intention evade the payment to the petitioner. Acting on the said report, the police officials are harassing the petitioner for no fault of him. Learned Assistant Government Pleader, on instructions, states that respondents police are not interfering with the civil disputes and if they have to interfere, it will be in accordance with law.

4. Recording the said statement, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order.
