Aggrieved by the seizure of essential commodities by the respondents, the present Writ Petition is filed. It is the case of petitioner that on an earlier occasion, due to rivalries in the village, when his fair price shop authorization was sought to be suspended, the petitioner approached this Court in Writ Petition No. 3258 of 2015 and this Court by order dated 16.02.2015 granted interim suspension while giving liberty to the respondent authorities to conduct an enquiry and pass final orders in accordance with law. It is

submitted that as of today, no orders have been passed pursuant to the enquiry conducted by the authorities. However, once again the essential commodities have been seized on account of certain irregularities highhandedly.

In the panchanama conducted on 4.6.2016 pursuant to the seizure of goods, 2924.5 Kgs of rice, 71 Kgs of sugar and 210 liters of kerosene was shown as shortage. However, as a matter of fact, the goods are available in the godown and the petitioner has filed photographs along with the Writ Petition evidencing the same. Against the high handed action of respondents 7 and 8, the petitioner made a complaint/representation to the third respondent on 06.06.2016. The petitioner prayed that the third respondent may be directed to examine the said complaint and take appropriate action against respondents 7 and 8 and thereafter release the goods seized under the panchanama dated 4.6.2016.

Considering the limited scope of prayer as sought in the Writ Petition, the third respondent is directed to consider the complaint of the petitioner dated 6.6.2016 and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
