HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.6349 of 2019 ORDER:

The grievance of the petitioner is that the Tahsildar, Kosgi Mandal, Mahabubnagar District, is not taking any action upon his representation dated 13.8.2018 whereby the petitioner sought mutation in his favour in relation to certain extents of land in Sy.Nos.294 and 295 of Polepally Village, Kosgi Mandal, Mahabubnagar District. He claims rights over the subject lands under a registered sale deed.

Perusal of the record reflects that the petitioner did not submit an application in the prescribed format in Form VI (A) as required by Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989 for mutation being effected in his favour in the revenue records in relation to the subject lands. Without submitting an application in the proper format, it is not open to the petitioner to complain of inaction on the part of the revenue authorities.

The Writ Petition is accordingly disposed of permitting the petitioner to submit an application in Form VI (A) along with the requisite fee and necessary documents on-line. In the event such an application is filed, the Tahsildar, Kosgi Mandal, Mahabubnagar District, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt of such application.

Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 13th June, 2019.
