THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 25866 of 2016 ORDER:

This Writ Petition has been filed seeking a mandamus for declaring the action of the respondent authorities in earmarking part of the agricultural lands of the petitioners admeasuring Acs.2.08 guntas in Survey No. 145/ , Acs.7.05 guntas in Survey No. 145/ , Ac.1.15 guntas in Survey No. 146/ , Acs.3.24 guntas in Survey No. 150, Ac.0.07 guntas in Survey No. 148/ , Acs.3.34 guntas in Survey No. 149/ situated at Khanapoor Village, Atmakur Mandal, Mahabubnagar District for the purpose of widening the road from Atmakur to Priyadarshini Jurala Project dam via Mullamalla Village from 0.00 to 10.590 and WBM formation for link from Mullamalla Village to Nandimalla ghat through PJP LMC inspection path from KM 0.0000 to KM 4.250 in Atmakur Mandal, Mahabubnagar District, without following the due process of law, as illegal and arbitrary. Heard learned counsel for the petitioners.

Learned Government Pleader for Irrigation (Telangana) fairly submits that in view of the on-coming KRISHNA PUSHKARALU, e-procurement tender notice dated 13.05.2016 has been issued for undertaking certain development works and he assures this Court that the respondent authorities will follow the due procedure prescribed while carrying out the works notified therein.

In view of the assurance held out by the learned Government Pleader, this Writ Petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioners over the lands mentioned above, without following the due process of law. No costs.

Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
