Heard the learned counsel for the petitioner and the learned Government Pleader for Irrigation and Common Area Development, appearing for the respondents.

In this Writ Petition, the petitioner questions the action of the respondents in not releasing the amount of Rs.2,80,000/- to the petitioner even after completion of work by him relating to the improvements and repairs to Pedda Cheruvu, Annaram village, Tadwai Mandal, Warangal District. It was executed by the petitioner after an agreement was entered into between the petitioner and the respondent on 02-07-2007. Petitioner contends that the work entrusted to the petitioner was completed in 2009 itself and in spite of several requests, respondents are not releasing the final bill payable to the petitioner. 3.

Counter affidavit was filed by 3rd respondent admitting that the petitioner has properly executed the work entrusted to him as User Group Leader and also admitting that the final bill is still pending in 3rd respondent's office for want of some clearance from Project Director, ITDA, Eturnagaram (4th respondent). It was admitted that the amount still payable to the petitioner is Rs.3,23,363-63ps including recoveries; that on receiving notice in this Writ Petition, a separate office note was placed before 4th respondent for release of grant for payment to the petitioner; and that it is under process. The 3rd respondent states that on receipt of the grant, cheque would be issued to the extent of value of

work done and the amount would be paid to the petitioner and sought sometime for obtaining funds from 4th respondent. 4.

Having regard to the stand taken by 3rd respondent in the counter affidavit filed by him, the respondents are granted two months' time from date of receipt of a copy of this order to release the balance payment due to the petitioner as per the final bill payable for the work executed by the petitioner as User Group Leader pursuant to the agreement dt.02-07-2007 and it was completed on 02-07-2009 by him.

The Writ Petition is allowed with the above directions. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
