THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.16124 of 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"... to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in proposing to expand the tank into their lands under the guise of Mission Kakatiya without initiating land acquisition proceedings, is illegal, arbitrary and violative of Article 300-A of Constitution of India and to consequently direct the respondents not to interfere with the lands of the 1st petitioner admeasuring Ac.10.00 gts and Ac.8.00 each of the petitioners No.2 and 4 in Sy.No.154/E of Cheparlapalli Village, Mukkalapalli Mandal, Badradri Kothagudem District."

It is submitted, on instructions, by the learned Government Pleader that the respondents are not meddling with the private properties of the petitioners and they will undertake the works only to the extent of the land covered by the subject tank. Recording the said submission of the learned Government Pleader, the Writ Petition is disposed of.

Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
