THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21767 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondents in not regularizing the services of the petitioner as illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India and consequently to direct the respondents to regularize the services of the petitioner with effect from the year 1991 onwards with all consequential benefits. Learned counsel for the petitioner submitted that during the pendency of this writ petition, the services of the petitioner have been regularized with prospective effect in pursuance to the interim orders granted by this Court.

In view of the submission made by the learned counsel for the petitioner, the cause in the writ petition does not survive. If the petitioner is aggrieved with respect to prospective regularization, it is left open to the petitioner to challenge the same seeking regularization witth retrospective effect.

With the above observation, the Writ Petition is closed. No order as to costs.
