JUSTICE SHAMEEM AKTHER Writ Petition No.7096 of 2021 ORDER: (Per Hon'ble Sri Justice A.Rajasheker Reddy) Heard Sri N.Praveen Kumar, learned counsel for Sri N.Vasudeva Reddy, learned counsel for the petitioner and Sri V.V.Ramana, learned counsel for Sri Manohar Reddyb Nandyala, learned Standing Counsel for the 1st respondent Bank.

Sri V.V.Ramana, learned counsel for the 1st respondent Bank submits that the scheduled auction could not take place on 02.03.2021, as such, the cause in the writ petition does not survive for consideration.

On the other hand, Sri N.Praveen Kumar, learned counsel for the petitioner submits that they have challenged the auction and sale notice on certain grounds. He also submits that they have also paid an amount of Rs.2,00,00,000/-.

Since the scheduled auction could not take place, nothing survives for adjudication in the writ petition. However, if any auction notice issued, and if the petitioner still aggrieved by the same, they can challenge the same in accordance with law.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
