THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY M.A.C.M.A.No.1019 of 2006 JUDGMENT:

This appeal is preferred under Section 173 of the Motor Vehicles Act, 1988 by the appellant/petitioner challenging the judgment and award, dated 31.12.2005, passed in M.V.O.P.No.471 of 2004 on the file of the Chairman, Motor Vehicles Accidents Claims Tribunal-cum-V Additional District Judge (F.T.C.), Guntur. Learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal with liberty to file an Execution Petition against the first respondent. Permission is granted.

Accordingly, the Appeal is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
