O R D E R
This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.2 in FIR No.13 of 2026 of Gudur Police Station, Mahabubabad District, registered for the offences punishable under Sections 34(E) of the TS Excise Act and 7(A) r/w 8 (E) of the TSP Act.

The case of the prosecution is that, on 17.01.2026, the defacto complainant, on reliable information, had conducted inspection and found DCM vehicle with a prohibited black jaggery,
- 2 - alum (patika) and Gudumba worth of Rs.8,38,500/-. On enquiry, they came to know that the petitioner herein is the main accused and he entrusted the work to accused Nos.1 and 3 to 7 for transportation of the same for making illicit gudumba and as the petitioner is arrayed as accused No.2, he was arrested. 3.
Heard Sri V. T. Kalyan, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 4.
Learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and even according to the prosecution case, the petitioner was not present at the DCM vehicle and he was voluntarily confessed to having committed the said offence and he was arrested at his house, which itself shows that he is falsely implicated in this case and he is in jail since 24.01.2026 and the material part of the investigation was already completed and mere pendency of other case, which was registered in the year 2022, is not a ground to dismiss the petition. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the
- 3 - petitioner stating that the petitioner herein is the habitual offender and he is the prime accused and he instructed other accused persons to transport the same for preparing the illicit gudumba. Further, the investigation is not yet completed. At this stage, the petitioner is not entitled for the bail and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 24.01.2026 and also initially the investigating officer served the notice under Section 35(3) of the BNSS and as he was not complied with the conditions, he was arrested. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 10 have already been examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Additional
- 4 - Judicial First Class Magistrate, at Mahabubabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
