THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.3217 of 2005 ORDER:

This civil revision petition is filed under Section 115 of CPC challenging the order dated 20.12.2004 in C.M.A. No.6 of 2000 on the file of I Additional District Judge, Srikakulam. 2.

Heard Sri V.Sudhakar Reddy, learned counsel for the revision petitioners and Sri Dantu Srinivas, learned counsel for respondent Nos.2 and 3.

3. The learned counsel for the petitioners submitted that the petitioners may be permitted to withdraw the amount of Rs.6,720/- deposited by respondent Nos.2 and 3 before the Authority under Payment of Wages Act, 1938 (Assistant Commissioner of Labour), Srikakulam to the credit of P.W. No.1 of 1997. The learned counsel for the respondent Nos.2 and 3 submitted that there is no objection for respondent Nos.2 and 3 to permit the petitioners to withdraw the said amount. Both the counsel, in one voice, submitted that the revision petition may be disposed of accordingly. The submissions are recorded.

3. In the result, the civil revision petition is disposed of. The Authority under Payment of Wages Act, 1938 (Assistant Commissioner of Labour), Srikakulam is hereby directed to permit the petitioners to withdraw Rs.6,720/- pending to the credit of P.W. No.1 of 1997. The revision petition against the first respondent shall remain dismissed. There shall be no order as to costs. Miscellaneous petitions, if any pending in the revision petition, shall stand closed.
