THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No. 451 OF 2016 O R D E R :
This Contempt Case is filed alleging violation of the order dt.08.09.2015 passed by this Court in WP.No.33481 of 2011, wherein and whereby this Court passed the following order. "....The District Panchayat Officer is, accordingly, directed to take appropriate decision regarding payment of amount due to the petitioner in WP.No.33481 of 2011 in pursuance of the comprehensive report, dated 24.07.2012, submitted by the Divisional Panchayat Officer, within a period of four weeks from the date of receipt of a copy of this order." Learned Government Pleader for Panchayat Raj submits that in pursuance to the aforesaid order in the writ petition, the respondents have considered the case of the petitioner and passed a detailed order on 18.03.2017, as such, there is no wilful violation of the orders passed by this Court.
Learned Counsel for the petitioner states that the respondents have not considered the claim of the petitioner in proper perspective and the findings in the said order are not based on record and that the respondents have denied the claim of the petitioner without any basis. In this case it is to be seen that the direction to the respondent in the writ petition was only to take decision and the respondent has taken decision. The correctness or otherwise of the said decision cannot be gone into in the contempt case.
In view of the same, I do not see any violation of the orders passed by this Court in the writ petition.
Accordingly the Contempt Case is closed. However, it is open for the petitioner to challenge the said order dated 18.03.2017 passed by the respondent, in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
