This writ petition is being disposed of at the admission stage with the consent of both the parties. This writ petition is filed for the following relief: ".........Writ of Mandamus declaring the action of the 2nd respondent in not considering the representation dated 08.03.2019 for modification of posting place in his promotion order Rc.No.ZVI/3034/Maths-2013/2, dated 06.03.2019 as illegal, arbitrary and violative of Article 14 and 16 of the Constitution of India and consequently direct the respondents to modify the place of posting in promotion order Rc.No.ZVI/3034/Maths-2013/2, dated 06.03.2019 of the 2nd respondent by considering the representation dated 08.03.2019........"

Heard Sri J.M.Naidu, learned counsel for the petitioner and Sri N.Bhupal Reddy, learned Standing counsel for respondents.

It has been contended by the petitioner that he has been working as Trained Graduate Teacher (TGT)-Maths with the respondents and the respondents vide proceedings dated 06.03.2019 had considered the case of the petitioner for promotion to the post of PGT (Maths) and posted the petitioner at Vikarabad. The petitioner further contends that as he is going to retire in the month

of June 2019 and is suffering with heart ailment, he submitted a representation on 08.03.2019 to the respondents seeking to consider his case for posting in the promoted post, anywhere in the twin cities of Hyderabad and Secunderabad, keeping in view his health condition. The grievance of the petitioner is that the respondents neither considered his representation dated 08.03.2019 nor considered his case for posting him in and around the twin cities of Hyderabad and Secunderabad.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 08.03.2019 and give a posting in and around the twin cities of Hyderabad and Secunderabad. Learned Standing counsel appearing for the respondents submits that there are no vacancies in and around the twin cities of Hyderabad and Secunderabad and as and when vacancies arise, the case of the petitioner would be considered in accordance with law and appropriate orders would be passed on the representation submitted by the petitioner.

This Court, having considered the rival submissions of the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation

submitted by the petitioner on 08.03.2019 and pass appropriate orders within a period of six weeks from the date of receipt of copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
