HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12518 of 2002 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioner submits that the disciplinary authority has imposed on the petitioner the punishment of withholding of annual increment for a period of one year with cumulative effect vide proceedings dated 26.11.1994. Aggrieved by the same, the petitioner has preferred an appeal before the appellate authority and the appellate authority was pleased to modify the punishment imposed by the disciplinary authority to that of without cumulative effect, vide orders dated 19.11.2001. The grievance of the petitioner is that the disciplinary authority is not implementing the orders of the appellate authority. Learned standing counsel for the respondents submits that the punishment imposed by the disciplinary authority has already been worked out and therefore the question of implementing the orders of the appellate authority would not arise.

In view of the above said submissions, this Court is of the considered view that the writ petition can be disposed of with a direction to the respondents to implement the orders of the appellate authority dated 19.11.2001, if not already implemented, within four weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 11th December, 2018 cbs
