THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4262 OF 2016 ORDER:
This Criminal Petition is filed by the petitioner/R-1 seeking to quash the proceedings in D.V.C.No.122 of 2015 on the file of the IV Additional Chief Metropolitan Magistrate (Traffic Mobile Court), Hyderabad.
2. Heard and perused the material available on record.
3. Respondent No.2 is the wife and respondent Nos.3 to 5 are the children of the petitioner. She filed the D.V.C. against the petitioner and others seeking certain reliefs under the provisions of the Protection of Women from Domestic Violence Act, 2005.
4. After arguing for sometime, learned counsel for the petitioner while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.
5. In view of the same and also considering the nature of allegations wherein the question of identity of the petitioner does not arise, the presence of the petitioner/R-1 is dispensed with before the trial Court except on the dates on which the learned Magistrate insists for his presence. The petitioner shall be properly represented through his counsel before the trial Court.
6. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed. _________________________ JUSTICE RAJA ELANGO 29.3.2016
