HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9878 of 2017 ORDER:

The case of the petitioner is that the 3rd respondent herein and others filed application under Sections 40 and 32(2) of Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950 (for short "the Act") and the same was disposed of by the Tahsildar, Saroornagar advising them to approach Civil Court. Against the said orders, the 3rd respondent filed appeal under Section 90 of the Act before the 2nd respondent and notices were also issued to the petitioner and other parties to the appeal. The petitioner has also filed counter. Inspite of the same, the 2nd respondent is not disposing of the appeal. Aggrieved by the same, the present writ petition is filed. Heard both sides.

In view of the facts and circumstances of the case, the 2nd respondent is directed to dispose of the appeal filed by the 3rd respondent in Appeal No.F2/5891/2013 in accordance with law after issuing notice to the parties to the appeal and after affording opportunity of hearing to them within a period of four months from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of.
