THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26932 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of respondent No.4 in passing orders dated 11.07.2016 vide D.Dis.No.541/2016/B1 by cancelling authorisation of the petitioner in respect of F.P.Shop No.38 of Nethrapalli Village, Gummagatta Mandal, Anantapur District, as illegal and arbitrary.

At the time of argument, the learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition with liberty to file an appeal before the third respondent within fifteen (15) days from today. The learned Assistant Government Pleader for Civil Supplies also consented for the same. Permission is granted.

Having regard the submissions made by learned counsel for both parties, the Writ Petition is dismissed as withdrawn granting the liberty as prayed for. The third respondent is hereby directed to take the appeal, if any, filed by the petitioner on or before 24.08.2016 and dispose of the same in accordance with law.

No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
