THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.12980 of 2007 ORDER:

The petitioner prays for Mandamus declaring that the provisions of the Standards of Weights and Measures Act, 1976 and the Standards of Weights & Measures (Enforcement) Act, 1985 and the Rules made thereunder are not applicable to the electronic goods manufactured and sold by the petitioner by mere interpretation and application of the said enactment and also that to extend the applicability no notification is issued by the respondents. The petitioner relies upon TITAN WATCHES LTD V. SENIOR INSPECTOR, LEGAL METROLOGY W & M DEPARTMENT[1] as confirmed in W.A.Nos.1448 of 2004 and 1598 of 2005, dated 03-092015. Learned Assistant Government Pleader, on instructions, submits that as on date, no notification is issued extending the applicability of the above said enactment to the electronic goods manufactured and sold by the petitioner company. He further consents that the issue is substantially covered by the decisions, referred to above.

The writ petition is accordingly allowed in terms of the aforesaid decisions. No order as to costs.
