THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.209 of 2017 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to respondents 2 to 4 to provide police protection to the petitioner and his family members during their stay at Hyderabad. The petitioner is A.1 in C.C.No.179 of 2015 pending on the file of XV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad for the offences under Sections 498-A and 506 IPC. It is the case of the petitioner that he is working at Doha Qatar; that due to matrimonial disputes, his wife deserted him and left to India; that he divorced her on 25.8.2012; and that on the complaint lodged by her, the present case is pending against him. Now, it is the grievance of the petitioner that he is willing to travel to India, but however, in view of the threatening calls and messages from the father of his divorcee wife, he is seeking police protection during his stay in India.

Heard and perused the material available on record. Considering the facts and circumstances of the case, the petitioner, on arrival of India, can file a petition before the respondentspolice explaining the necessity for providing protection and on filing such petition, the respondents-police are directed to take action in accordance with law.

The writ petition is disposed of accordingly. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 03.01.2017.
