Heard before admission the learned counsel for the petitioner and the learned Public Prosecutor, representing the State - respondent and perused the dismissal order dated 15.03.2019, passed by the learned XII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad in Crl.M.P.No.1462 of 2019 in C.C.No.223 of 2015 for recall of warrant filed under Section 70 (2) Cr.P.C., without even presence of the petitioner when filed, so also not present when warrant issued, the petition is disposed of rather than dismissal, for nothing to interfere with the order but for to say remedy is left open by virtue of this order to appear and file an application for recall to consider subject to payment of penalty and earlier bond for the application by the non appearance as per the bond conditions, so to recall, if bail already not cancelled.
