THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.3087 of 2025 ORDER:
This Criminal Petition is filed under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of prearrest bail to the petitioner in connection with an unregistered crime of Thangallapalli Town Police Station, Rajanna Sircilla. 2.
Heard Sri T.Sai Krishna, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent.

The contention of learned counsel for the petitioner is that though the petitioner was assigned land, recently some complaints were raised by the Revenue Inspectors stating that petitioner and some others grabbed the Government land by way of forging the documents and number of FIRs were registered against the persons whose names are reflected in the news item. As such, petitioner is apprehending arrest in respect of land admeasuring Ac. 2-00 gts in Sy.No.1183/5, situated at Jillella Village, Thangelapally Mandal, Rajanna Sircilla District. As such, prayed this Court to allow the Criminal Petition by granting pre-arrest bail to the petitioner.

On the other hand, learned Additional Public Prosecutor would submit that as on today, no complaint is filed against this petitioner, no FIR was registered against him and on mere apprehension, bail cannot be granted and as such, prayed this Court to dismiss this petition.

Considering the submissions made by both the counsel and the material on record, the petitioner herein filed Patta pass book bearing No.T19090150202 issued in his favour. It is apparent that though it is alleged that using influence of the political party, the petitioner and other persons have grabbed the land by forging the documents, the petitioner herein filed documents to show that he is in possession of schedule land and his possession is recorded in the pahanies. considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:
i.
The petitioner shall be released on bail in the event of arrest on furnishing personal bond of Rs.25,000/- with two sureties, for the like sum each to the concerned Investigating Officer.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita,
and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
