THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37216 OF 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the third respondent in taking steps to appoint a Non-hereditary Trust Board to Sri Chennakesava Swamy Temple, Chandrayanagutta, Hyderabad, without disposing of the representation of the petitioners, dated 27.09.2016, as illegal and arbitrary, and consequently, to direct the third respondent to dispose of the application of the petitioners.
Heard and perused the material.
Learned counsel for the petitioners submits that the petitioners made a representation to the third respondent on 27.09.2016 to drop and withdraw the proposals for appointment of Trustees to the above mentioned Temple. He further submits that without disposing of the said representation, the third respondent is taking steps to appoint a non-hereditary trust board to the Temple and as such, he prays this Court to direct the third respondent to dispose of the application of the petitioners before taking any further proceedings. Considering the facts and circumstances of the case, the third respondent is directed to dispose of the representation of the petitioners, dated 27.09.2016 as expeditiously as possible, preferably within a period of two months from the date of receipt of copy of this order.
