THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

On 27.04.2017 in W.P.M.P.No.19315 of in W.P.No.1567 of 2017 this Court directed respondents 1 and 2 herein to consider the case of the petitioner for promotion as Executive Engineer as per the provisional integrated list of Deputy Executive Engineers vide Memo, dated 13.03.2017, if he is otherwise eligible and qualified to the existing vacancies. 2.

Alleging that the said order is not complied with, the present Contempt Case is filed.

During hearing, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for the respondents informs the Court that the petitioner filed W.P.No.10837 of 2018 on the very same issue wherein the learned single Judge of this Court initially passed interim orders on 03.04.2018 not to make any promotions, which order was subsequently modified directing the respondent authorities to make promotions on adhoc basis. Aggrieved by the same, the petitioner filed W.A.No.361 of 2019 and the Division Bench of this Court stayed the order passed by the learned single Judge. 4.

In view of the orders passed by the Division Bench of this Court staying the promotions, it cannot be said that the respondents have violated the orders passed by this Court so as to initiate contempt proceedings against them.

Accordingly, the Contempt Case is closed. Miscellaneous Petitions, if any, pending in this Contempt Case shall stand closed. There shall be no order as to costs.
