ORDER:

This petition is filed to withdraw H.M.O.P.No.132 of 2014 from the Court of Senior Civil Judge ,Khammam and transfer the same to the Family Court, City Civil Court, Premises, Secunderabad for disposal in accordance with law.

Wife filed this application and according to her affidavit, she filed C.C.No.913 of 2010 and the same is pending before XIII ACMM, Nampally at Hyderabad and she also filed M.C and D.V.C. which are also pending before III Metropolitan Magistrate, Erramanjili, Hyderabad and that she has got minor daughter aged about 6 years and it is difficult for her to go to Khammam for defending this case leaving her minor daughter. For these reasons, she prayed for transfer of Marriage O.P. from Senior Civil Judge, Khammam to Family Court, Secunderabad.

Respondent-husband filed counter disputing affidavit averments of the petitioner and contended that the present application is filed only to harass him and that there is no inconvenience for the petitioner to attend Khammam and the grounds urged for transfer are unreasonable and unjustified.

From the submissions of both sides other cases are pending in Criminal Courts at Nampally for which respondent herein is attending

and defending those cases. Considering the convenience of wife and for the reasons stated in the affidavit, I feel that her request for transfer can be considered. But as the other criminal cases are pending in the criminal court complex, I feel that it will be convenient if O.P. is also transferred to the Court of Additional Family Court, situated in Criminal Courts' complex, Nampally, Hyderabad. Accordingly, H.M.O.P is withdrawn from Senior Civil Judge, Khammam and transferred to Additional Family Court Complex, Nampally, Hyderabad for disposal in accordance with law. Accordingly, this Transfer C.M.P. is disposed of. No costs.
