THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1344 of 2017 ORDER:

The order complained of in the Contempt Case is only relating to disposal of the representation, dated 27.10.2016, of the petitioner, who made a complaint against the Station House Officer, B. Mattam Mandal P.S., that he had behaved rudely and caused injuries to his father.

Learned counsel for the petitioner strenuously contends that the disposal of the representation of the petitioner has not been done by the Superintendent of Police, SPS Nellore District, in a proper manner and he further submits that it reflects the nonapplication of mind on the part of the 1st respondentSuperintendent of Police in considering the various issues raised by the petitioner. In those circumstances, learned counsel for the petitioner vehemently contends that the Superintendent of Police had committed contempt and prays for proper action. On the other hand learned Government Pleader appearing for the Superintendent of Police submits that based on the material on record he had considered and disposed of the representation made by the petitioner.

He further submits that the direction is only to consider and dispose of the representation of the petitioner, the merits of the matter cannot be gone into by this Court in contempt proceedings. In case, the petitioner is aggrieved by the orders of the Superintendent of Police it would be open for him to avail the remedies available under law.

Having considered the respective submissions, prima facie consideration of the representation does not instill confidence in this Court, however, considering the limited scope of the proceedings under the Contempt of Courts Act, this Contempt Case is closed, leaving it open to the petitioner to avail the remedies available under law.
