ORDER

This petition is filed to withdraw the O.P.No.292 of 2007 from the file of Family Court, V Additional District and Sessions Judge, Visakhapatnam and transfer the same to Family Court, Secunderabad.

Husband filed this application seeking transfer of OP from Visakhapatnam to Secunderabad.

Inspite of service of notice, respondent neither appeared in person nor through any Advocate.

Heard arguments.

Advocate for the petitioner submitted that husband filed O.P.No.292 of 2007 for divorce and dissolution of the marriage and the same was allowed on 13-06-2007 and an exparte decree is passed. It is submitted that wife filed earlier Tr.C.M.P.No.240 of 2007 and this Court ordered transfer of O.P.No.292 of 2007 from Family Court, Visakhapatnam to Family Court, Secunderabad but the same is not materialised because of the exparte decree and subsequently, wife filed a petition with delay petition to set aside the exparte decree and that the petition was allowed and the OP is now restored and coming-up for enquiry. It is submitted now the husband filed present petition for transfer of O.P., which is also convenient to the wife. He submits that present petition is nothing but implementation of the earlier transfer order of this Court in Tr.C.M.P.No.240 of 2007.

I have perused the material papers and in view of the circumstances stated by the petitioner, O.P.No.292 of 2007 is withdrawn from the file of Family Court-V Additional District and Sessions Judge, Visakhapatnam and transferred to Family Court, Secunderabad for disposal in accordance with law. This petition is allowed accordingly. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed.
