ORDER
This writ petition is filed seeking to declare the action of the respondents in not appointing the petitioner on compassionate grounds in any suitable post in the respondent-Corporation, as arbitrary and illegal.
The father of the petitioner viz., Dharma Raju was appointed as Junior Lineman Trainee and posted at Chinthaluru and his services were regularized with effect from 18.01.1999.
Subsequently, the 3rd respondent terminated his services vide Memo dated 21.12.1999 without conducting any enquiry and without affording an opportunity of being heard on the ground that the Transfer Certificate produced by him was not in his name. When the TC was sent for verification, it did not tally with the records and in the school records, his name was shown as Dharmaraju whereas in other records, it was shown Dharma Rao.
Challenging the said termination order, the father of the petitioner filed W.P.No.26736 of 1999 and this Court passed interim order to continue him in service and as per the said order, his services were
continued, but unfortunately he died on 11.8.2011. Within one year from the date of death of his father, the petitioner made an application dated 18.11.2011 to the respondent seeking appointment on compassionate grounds and as there was no response from the respondents, the petitioner made further representations and the last one being dated 14.2.2015.
Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 3rd respondent to consider the case of the petitioner for appointment on compassionate grounds, subject to his eligibility and as per Rules within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
