THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5503 of 2017 ORDER:
This Writ Petition is filed challenging the action of respondent Nos.3 to 5 in interfering with the petitioners' possession in collusion with respondent No.6 by receiving a false complaint and issuing notice under Section 91/160 Cr.P.C vide proceedings dated 25.01.2017.
This Court does not find anything wrong with the notice issued, but the learned Counsel for the petitioners apprehends that in the guise of investigation, the Police would interfere with the possession of the property contrary to the decrees passed by the Civil Court.
The Writ Petition is, therefore, disposed of observing that the Police shall follow due process of law during the course of investigation. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
